Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the APNA Live mobile app and the website apna-live.web.app (together, the "Service"). The Service is owned and operated by INDRAPRASTH AGENCY, a proprietorship of Neha Devi Ghoshi (GSTIN 23DJEPG3309G1ZP), of Gram Panchayat Panya, Post Kutora, Tikariya, District Chhatarpur, Madhya Pradesh 471313, India ("APNA Live", "we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

• You must be 18 years of age or older to use APNA Live.
• You must be legally able to enter into a binding contract under Indian law.
• We may suspend any account that we reasonably believe belongs to a minor.

2. Your account

• You sign in with a mobile number verified by a one-time password (OTP). Keep your phone and OTP private. You are responsible for all activity on your account.
• Give accurate information and do not impersonate any person.
• One person should not create multiple accounts to get around a suspension or ban.
• You can delete your account at any time. See Delete your account.

3. Community rules

When you use APNA Live, including in live audio or video, chat, profile photos and names, you must not:

• post or stream nudity, sexual or pornographic content, or offer escort or sexual services;
• post anything that sexualises, endangers or exploits a minor (see our Child Safety Standards);
• harass, bully, threaten or abuse anyone, or post hate speech against any religion, caste, community, gender or group;
• promote violence, self-harm, drugs, weapons, gambling, betting or any illegal activity;
• cheat, spam or scam other users, or ask them for money or personal details;
• use content that you do not have the right to use;
• interfere with the Service, hack it, or use bots, scripts or modified apps.

Users can report and block others in the app. We review reports and may remove content, warn, mute, suspend or permanently ban accounts and devices, without prior notice, if we believe the rules have been broken. We may also share information with law-enforcement authorities where the law requires it.

4. Coins and virtual gifts

• Coins are a virtual item that you can buy in the app's Coin Store. Their only use is to send virtual gifts to hosts inside APNA Live.
• Coins and virtual gifts are a limited, personal, non-transferable licence to use a feature of the app. They are not money, have no cash value, and are not a deposit, a wallet balance, a prepaid payment instrument or a digital currency.
• Coins cannot be withdrawn, refunded for cash (except as set out in our Refund & Cancellation Policy), sold, transferred, traded or exchanged between users or outside the app.
• Gifts sent to a host are final once sent.
• APNA Live has no games of chance, betting, lottery, contests with cash prizes, mystery boxes or random rewards. Every gift has a fixed coin price that is shown before you send it.
• Prices of coin packs and gifts are shown in the app and may change from time to time. The price shown at the time of purchase applies.
• We may remove coins that were obtained by fraud, a payment reversal or chargeback, a technical error, or a breach of these Terms.
• If your account is banned for breaking these Terms, or you delete it, any unused coins are forfeited.

5. Payments

• Coin packs are paid for through UPI via our payment partners. We do not see or store your UPI PIN, card number or bank password.
• Coins are credited once the payment is confirmed by our payment partner.
• For failed, pending, duplicate or disputed payments, our Refund & Cancellation Policy applies.
• You agree not to raise a false chargeback or payment dispute for a purchase that was delivered.

6. Hosts and creator rewards

Hosts who receive virtual gifts earn creator rewards (shown in the app as diamonds). Creator rewards are paid by APNA Live from its own revenue to eligible, verified hosts who complete KYC and give bank details, under our Host Payment Policy and, where applicable, our Agency Payment Policy. Rewards may be withheld or reversed where they come from fraud, self-gifting abuse, payment reversals or a breach of these Terms. Applicable taxes may be deducted as required by law.

7. Your content

You own the content you create. By going live or posting on APNA Live, you give us a non-exclusive, royalty-free licence to host, stream, display and store that content so we can run the Service. You are responsible for your content and confirm that you have the right to share it. We are not responsible for content posted by users, but we act on reports and on valid legal requests.

8. Our rights

The APNA Live name, logo, app, design, gifts, animations and software belong to INDRAPRASTH AGENCY or its licensors. You may not copy, modify, reverse-engineer or resell any part of the Service.

9. Suspension and termination

We may suspend or end your access to the Service at any time if you break these Terms, if the law requires it, or to protect other users or the Service. You may stop using the Service and delete your account at any time.

10. Disclaimers and limitation of liability

The Service is provided "as is" and "as available". We do not promise that it will always be available, uninterrupted or error-free. To the fullest extent allowed by law, APNA Live is not liable for any indirect or consequential loss, or for the conduct of any user. Our total liability for any claim relating to a purchase will not be more than the amount you paid for that purchase.

11. Governing law and disputes

These Terms are governed by the laws of India. Please contact us first so we can try to resolve any issue. Subject to that, the courts at Chhatarpur, Madhya Pradesh will have jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above will change, and continuing to use the Service after an update means you accept the new Terms.
